At Smarkia we respect your privacy. This policy explains what personal data we collect, why, and the rights you have over it.
1. Data controller

2. What data we process and why
We process the data you provide as a prospective customer or business contact to respond to your requests and, where applicable, send you commercial communications about our products and services, including by electronic means. If you do not provide the data, we may not be able to fulfil these purposes. No automated decisions are made.
3. Legal basis
Performance of a contract or pre-contractual measures (GDPR art. 6.1.b) for managing prospects; your consent (GDPR art. 6.1.a; LSSICE art. 21) for commercial communications; and our legitimate interest (GDPR art. 6.1.f) for managing professional contact data.
4. How long we keep your data
We keep your data until you request its deletion. Data from job applicants is kept for two years from the last interaction.
5. Who we share your data with
We do not transfer your data to third parties except where legally required, or to the service providers (processors) that help us operate the platform, such as cloud hosting, analytics and communication tools. These providers act under a data processing agreement and may be updated from time to time.
6. International data transfers
Smarkia operates internationally, including in the United States. Where your data is transferred outside the European Economic Area, we rely on appropriate safeguards such as the European Commission Standard Contractual Clauses or adequacy decisions.
7. Your rights
You may access, rectify, erase, restrict, object to the processing of your data, and request its portability, at rgpd@smarkia.com. Where processing is based on consent, you may withdraw it at any time. You may also lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) or your local supervisory authority.
8. Job applicants
We process the CVs and information provided by candidates to manage personnel selection. Legal basis: performance of a contract or pre-contractual measures. Data is not shared with third parties unless legally required, and no special categories of data are processed.
9. United States residents
If you are a resident of California or another US state with privacy legislation, you may have additional rights, including to know, delete and correct your personal information, and to opt out of its sale or sharing.
